1. What is copyright?

Copyright is for the creators of original works of authorship such as literary works, dramatic, musical works, artistic works, cinematographic films and sound recordings. It is used to provide a protection to the work created by the creators. Literary works includes computer programs, tables and compilations including computer databases which could be expressed in words, codes, schemes or in any other form, including a machine readable medium.

2. What does it protect?

Copyright law protects the expressions rather than the ideas. You can protect your literary works, dramatic works, musical works, artistic works, cinematograph films and sound recording as provided Under section 13 of the Copyright Act 1957. For instance: Books and computer programs are protected under the Act.  Literary works includes computer programs, tables and compilations including computer databases which could be expressed in words, codes, schemes or in any other form, including a machine readable medium.

3. Copyright vs. trademark vs. patent - What's the difference?

  • A copyright protects the original works of authorship, such as a book, song or movie. Copyright law protects the expressions rather than the ideas.

  • When you have to protect a word, phrase, symbol or design which refers to a different identity of any goods and services then it’s trademark.

  • A patent protects an unique invention or discovery.

4. When is something copyrighted?

First of all, your work should be an original work then it needs to be in a tangible form. Copyright provides you a protection against those who may try to infringe upon your creation.

5. Does copyright apply to titles and names?

Copyright does not protect titles or names, short word combinations, slogans, short phrases, methods, plots, or concepts. Copyright law protects the expressions rather than the ideas. The work should be original to get copyrighted.

6. Where can I file an application for registration of copyright for a work?

The Copyright Office has been set up to provide facilities of registration to all types of works and is headed by a Registrar of Copyrights and is located at Plot no. 32, Boudhik Sampada Bhawan, Sector 14, Dwarka, New Delhi- 110078. You can file your application by post also. The facility of filing an application online also provided by the office. 

7. Can computer software or computer programme can be registered?

Yes, you can register computer software or computer programme as literary work. Literary works includes computer programs, tables and compilations including computer databases which could be expressed in words, codes, schemes or in any other form, including a machine readable medium.

8. What is the procedure for registration of a work under the Copyright Act, 1957?

The procedure for registration is as follows:

  1. First of all, you have to file an application for getting your work copyrighted. You can file an application for registration with the help of Form XIV.

  2. Each work should get registered under separate applications.

  3. Then, while filing the application the fees mentioned in the second schedule of the rules have to pay.

  4. The applicant needs to sign the application. If applicable, then The Power of Attorney signed by the party and accepted by the advocate should also be enclosed.

  5. The fee is to be paid either in the form of Demand Draft or Indian Postal Order favouring "Registrar Of Copyrights Payable At New Delhi" or through E payment Each and every column of the Statement of Particulars and Statement of Further Particulars should be replied specifically.

9. What are the documents required to get the copyright registration?

The basic documents you need to get your work copyrighted is name, address and nationality of the applicant. The copies of your work which is mandatory to be original. The ID proof of the owner and Incorporation certificate in case of business.
