Ministry of Corporate Affairs has issued a notification dated 20th March 2020 to all the corporates including Companies and LLPs. All the companies and LLP’s are advised to robustly put into practice the “Work from Home” policy in their headquarters and field offices.
The Companies affirmation of readiness form is being introduced purely as a confidence structure measure to determine the willingness of companies to deal with the virulent disease. Companies affirmation of readiness form is released for the affirmation by every organization that they are following the regulation for the betterment of every employee and their interest as well.
- It is simple web based form, easy to file from anywhere.
- MCA has not issued any notification regarding due date of filing the form.
- No payment in relation to fees is to be made.
- No Digital Signature Certificate (DSC) is required for filing the form.
- If you are a registered user or a business user you can use this service called ‘Post Login’ Service.
- Applicable on Indian Companies/Foreign Companies/LLPs/Foreign LLPs.
- One-time password (OTP) is required for verification.
- No Service Request Number is required.
- Submission of form shall be done by the authorized signatory of the company or LLP.
- System produced acknowledgment shall be provided to;
Email id of the organization (Company/Limited liability partnership/foreign company)
Email id of the respective authorized signatory who is giving the affirmation in the form
Email id of the FO who is providing the affirm the regulations (*FO=financial officer)
Guidelines to file
Step 1: Enter valid CIN/FCRN/LLPIN/FLLPIN of the entity
Step 2: Then the press button below will be available to prefill the details.
Step 3: This will allow the system to prefill the name of the company/foreign co/LLP/foreign LLP.
Step 4: Selection is to be made whether company or LLP is in Compliance of COVID-19 guidelines (including work from policy)
Step 5: Select whether the authorized signatory who is giving the statement is having a valid director identification number or PAN or Membership Number. (It is to be ensured that the authorized signatory is currently associated with the concerned company/LLP)
Step 6: A valid director identification number to be entered in case the individual is director, PAN in case of the other key managerial personnel or Membership Number of Company Secretary in full time employment.
Step 7: Then the prefill button is active.
Step 8: If one has mention the director’s din number then mobile number available in database will be shown as prefilled. (In case it is not prefilled then this field can be filled)
Step 9: Click on the Send OTP, it will enable the system to send the OTP on the entered/prefilled mobile Number.
Step 10: Enter the received OTP and click on the verify OTP.
Step 11: Once OTP is verified, success message shall be shown.
Step 12: Then finally submit the form.
